These Terms of Service ("Terms") govern your use of MochaDash ("Service"), operated by MochaDash ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms.

1. Service Description

MochaDash is an analytics dashboard that aggregates data from your Shopify store, Google Analytics, Google Ads, and Klaviyo accounts. The Service displays this data in unified dashboards and delivers scheduled email reports.

2. Account Registration

To use MochaDash, you must create an account and connect at least one Shopify store. You are responsible for:

• Providing accurate account information
• Maintaining the security of your login credentials
• All activities that occur under your account
• Ensuring you have the authority to connect the accounts you integrate

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service's infrastructure
• Use automated systems to access the Service without permission
• Share your account credentials with third parties
• Resell or redistribute the Service without authorization

4. Subscription and Billing

MochaDash offers subscription plans with different feature tiers. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscription fees are billed in advance on a monthly or annual basis
• Prices may change with 30 days notice
• Refunds are provided at our discretion

Payment processing is handled by Stripe. Your payment information is stored securely by Stripe and is not accessible to us.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

6. Intellectual Property

The Service, including its design, features, and content, is owned by MochaDash and protected by intellectual property laws. You retain ownership of your data. By using the Service, you grant us a license to process your data as necessary to provide the Service.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of analytics data or insights
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months

8. Indemnification

You agree to indemnify and hold harmless MochaDash from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

9. Termination

You may cancel your subscription at any time through your account settings. We may terminate or suspend your account if you violate these Terms. Upon termination, your access to the Service will end and your data will be deleted according to our data retention policy.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction where MochaDash operates, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.
